General Information on Spanish laws and rules.

Marriage is legal for persons over 18.

Those under 18 may obtain permission if their parents go to Court and sign the  necessary papers

Same sex legal Civil marriages are legal since June 2005.

LEGAL MARRIAGES

 

Civil Weddings

 

Many Town Councils now state that at one of the couple  have to be resident here for at least 2 years. e.g. Moraira, Torrevieja.  A few Towns will allow a Civil wedding for those  that apply with the correct paper work, even if they do not live in Spain all the time, or have lived here for less than 2 years- although this is getting more rare. There are many different rules and by-laws in various towns and these are changing regularly.

For this reason we always have to obtain the most recent information in the Town where you want your wedding before we can advise you on the procedure, venue, and  paperwork.  Some areas allow a Civil ceremony 7 days a week, others state only on certain days. Some towns allow only the Registry Office use, whilst a few will agree to civil marriages in private premises such as a Hotel, or other venue. 

 

Outdoor legal weddings are allowed in certain areas- with permission of the Town Hall and payment of  a fee ( unless it is on privately owned premises or land)  or by Moraira Castle on the sea front ( as seen below) , Santa Pola castle,  and at Xativa Castle nr. Valencia.   (Civil marriages only)

Summer 2008- Moraira Castle is not available Monday to Fridays in June to Sept-  due to an exhibition inside the castle. However  Saturdays and Sundays are allowed in this time.

The cost is now 200 Euros to hire. (Civil marriages only) The ceremony can be held outside on the terrace or inside the castle. Blessings are not allowed here.

 

A Civil wedding is conducted in Spanish by the Judge in charge, the Mayor or the officer duly authorised for that Town.    Two witnesses ( not related) are usually required, and some Towns will only have Spanish speaking Officiators, therefore you will need a translator for the ceremony.

 

Catholic weddings

 

Legal and allowed if you are a practising Catholic. A pre-wedding ( pre-caņa) Course of about 6 hours is required in your own Country or in Spain. If one of the couple is not a Catholic, then dispensation is required from the Bishopric.  You cannot be divorced.

 

          

  

          

Many of the Catholic churches allow you to bring your own Priest. Although you do not have to live or be registered here in Spain, some Priests now prefer that you have family living here and they attend the Church.

Those that live here need to have at least one of the couple with a  minimum of 2 years registration here.

After the wedding you have to register with the Civil Registry here after the marrige to obtain the 'Libro de Familia' - so it is legal in the UK and elsewhere.

 

Arras- 13 Gold Coins ceremony 

Some Catholic Churches offer incorporation of this old tradition into a wedding ceremony. Thirteen gold coins (arras) are given to the bride by the bridegroom, signifying his willingness to support and care for her. 

 

                       

 

These are usually presented in ornate boxes or on a gift tray, and represents the brides dowry and good wishes for prosperity. The coins become a part of the family heirloom.

The coins are available from us at a very reasonable price - but are, of couse, not real gold. Genuine gold ones are also available if requested.

 

Same sex marriages

 

'Gay & 'Lesbian ' Civil weddings are legal.  However, the application of the new law varies from town to town.  Some Councils are still reluctant to comply, so it is important that we obtain the most recent information regarding the current situation when clients contact us with a Town in mind for their marriage.

 

 

In the North Costa Blanca area- Valencia, Denia, Moraira, Calpe, Murla and Benidorm are some of the Towns that have already held same sex weddings, and other places are expected to follow suit before too long.

None of the Churches in Spain will agree to same-sex weddings, therefore they will only be at Civil Registry Offices or another venue, depending on the Town and what they will allow.

Paperwork

 

Paper work can be very slow, tedious and confusing!  Although many articles and websites state up to 6 weeks- we know from experience it can take as many months. Bear in mind that some of the Town Halls here close for parts of August and many businesses, including Lawyers, have the whole month on holiday.  

You can organise the paperwork yourselves. Its is quite costly. We can assist and  you can use the services of a good Lawyer for a fixed fee ( please ask us for details.)

 

Documentation for Civil legal Marriages

 

Civil marriage paperwork can take 4-6 months. Please do not apply with all your documentation less than the minimum - 3 months-  before your proposed date for a Civil wedding.  

If you do not reside here all the time you will need visits here prior to your wedding to organise this documentation.

All UK or other Country documents must be legally translated into Spanish to submit to the Town Hall. These must be signed by you after translation.

Your Birth Certificates and other documents must have the Official London Foreign Office 'Apostile Hague Convention' seal.

Each Town Hall (Ayuntamiento) must be contacted to find out what up to date documents they require - as this can vary in each area and can change 

Go to the British Consulate in Alicante with the correct documents for processing and the banns to be displayed.

After your ceremony you have to collect your 'Ecliesiatica de Matrimonio Certificado,' which is submitted to the local Minister of Justice at the Registro Civil, who checks , signs, stamps it, and issues you with the 'Libro de Familia.' (This may take a few weeks)

You can register your marriage with the British Consulate after the ceremony, who will send the papers to your General Registry, enabling you to get a copy of your marriage certficate in your own Country.

 

Documentation for Catholic Marriages

Catholic marriage documentation can take over 9 months or even a year.

Much of the paperwork is as above, but your own Priest and church will advise of their procedure and we can assist. Visit your own Parish Priest at least 9 months prior to your date. Register your marriage after the wedding at the local Civil Registry Office.

 

Legal Weddings in a Hotel, Restaurant or private Villa

In some areas weddings in Hotels, Restaurants & Villas are not approved as yet.    However, some councils are now changing their ideas and rules- so at the time of your enquiry, the up to date information is checked  in the area in which you request to be married.   Certain Towns now state that you can have a Civil Marriage in private premises.

 

Legal Weddings on a Beach

Only a few Councils will allow beach legal weddings in this area.  Again, rules are changing so we check up to date information for your area of choice.

 


BLESSINGS / RENEWAL OF VOWS

 

A much easier and less expensive alternative to being married legally in Spain is for the couple to have a wedding back in their own Country, or a visit to Gibraltar ( which is British), or to travel elsewhere to be married, then have a full 'white' blessing ceremony and reception here.

If you require - the ceremony can be very similar to a real legal wedding- guests would not know the difference.

Religious Blessings in Churches

 

Catholic Blessings are not normally allowed as in any Country.

The Anglican Church here states that for a blessing ceremony one of the couple should reside in Spain, or one of the couple's family must live here. Proof of family living here is required.

                          

Their local Anglican church or another may be used. A marriage certificate must be provided. Anglican churches state that the couple walk down the aisle together when having a 'blessing'.

Other types of churches vary on their stance and have to be consulted at the time.

 

Religious Blessings in Private Villas, Hotels, and other venues

 

Not a problem, no regulations-  a local Minister or other suitable person may conduct the ceremony. For this religious blessing Couples must provide a photocopy of their marriage certificate on first meeting with the Minister. They must have been married legally prior to the blessing ceremony. Certain areas will allow a small guest blessing on a beach out of season.

 

Blessing in an inflatable church

 

If you have spacious grounds why not make your blessing the most spectacular event! Hire the amazing inflatable church. The attention to detail is heavenly - complete with plastic "stained glass" windows and airbrush artwork which replicates the traditional church.

 

            

 

Inside the church has an inflatable organ, altar, pulpit, pews, candles and a gold cross. Even the doors are flanked by air-filled angels. Set up in just  two hours- and dismantled in less than one hour.  No problem with high heeled shoes either.

 

Blessing on a luxury Yacht

 

Up to 6 persons may board this beautiful yacht moored in Denia for a blessing. You may have a day trip, including food and drinks, or a short journey out in the bay for the ceremony. (Dependent on the season and weather.) A Minister or Officiator and photographer/videographer will be present. Flowers and decorations can be arranged.

These may be held in any venue- Villa, Hotel, restaurant, or on a boat- no documentation required.
